These Terms of Use (“Terms”) are an agreement between you and Truth Trade (“we”, “us”, “our”). They cover your use of truthtrade.co and the vehicle investigation reports we provide (together, the “Services”). By using the Services or placing an order, you agree to these Terms, our Privacy Policy and our Refund Policy. If you don’t agree, please don’t use the Services.
The short version
- We contact a car’s previous owner and research the vehicle, then send you a report. We can’t guarantee the owner will respond or what they’ll say.
- Reports are for your own decision about buying that car. Don’t share them publicly or use them to find or contact the owner.
- A report is not a mechanical inspection or a warranty. Always get a pre-purchase inspection.
- If something goes wrong, our responsibility is limited to what you paid for that report.
- Florida law applies. Contact us first and we’ll try to fix any problem directly.
1. Who can use the Services
You must be at least 18 years old and able to enter into a binding contract to order a report. By ordering, you confirm that the information you give us is accurate and that you are ordering for a lawful purpose.
2. What we provide
Truth Trade researches pre-owned vehicles that are for sale at dealerships. For each car you order, our team works to identify the vehicle’s last registered owner, reaches out to ask about the car’s history, and supplements what we learn with independent research such as public safety recall and complaint data and market pricing. Investigations are conducted by a Florida-licensed private investigator.
We don’t investigate new vehicles or private-party sales. We don’t accept orders for vehicles at dealerships in California, Maine, Massachusetts, New Hampshire, New Jersey, New York, Oregon, Vermont or Washington. We may decline or cancel any order, for example if a vehicle is outside our service area or an order appears to be for an improper purpose. If we cancel, we’ll refund you in full.
3. Timing and delivery
- We begin reaching out to the previous owner within 36 hours of your order, or within 18 hours if you add Rush.
- Once the previous owner is identified, we reach out six times by phone and text, typically over about a week. If there is still no response, the investigation ends and the Refund Policy applies.
- Reports are delivered as a PDF to the email address you give at checkout. Please make sure it’s correct and check your spam folder.
4. No guaranteed outcome
Talking with us is voluntary for the previous owner. Owners are under no obligation to respond, and we can’t guarantee that an owner will answer, what they’ll share or whether what they share is complete. What happens when an investigation can’t be completed is explained in our Refund Policy.
5. How to read a report
Every finding in a report is labeled so you know where it came from:
- Verified: confirmed by a document or a second independent source.
- Owner-reported: what the previous owner told us, recorded as given and not independently confirmed.
A report covers what we learned. A topic that never came up is left out rather than guessed at.
Reports describe what we learned as of the date issued. A report is not a mechanical inspection, appraisal, title search, vehicle history report, warranty or guarantee of the vehicle’s condition or value. Market prices, recall data and warranty estimates come from third-party and public sources and may be incomplete or out of date. We strongly recommend an independent pre-purchase inspection by a mechanic you choose before you buy any vehicle.
Your decision is yours. Reports are information, not advice. We don’t give legal, financial or mechanical advice, and we aren’t responsible for whether you buy a vehicle, the price you pay or the results of any negotiation.
6. How you may use a report
When you pay for a report, we grant you a personal, non-transferable license to use it to decide whether to buy that vehicle and to negotiate its purchase. You may share it with people helping you with that decision, such as a family member, your mechanic or your lender. You may not:
- Resell, publish or publicly post a report or any part of it, including on social media or review sites
- Use a report, or anything in it, to identify, locate, contact or harass the previous owner
- Try to obtain the previous owner’s name, contact details or other personal information from us
- Use a report for any purpose that violates the Driver’s Privacy Protection Act or any other law
We never disclose previous owners’ personal information to customers or dealerships.
7. Prices, payment and taxes
- Prices are shown before you pay and are charged in U.S. dollars when you place your order.
- Payments are processed securely by Stripe. We never see or store your full card number.
- Sales tax is added at checkout where it applies, based on the dealership’s state and the state you live in.
- The Rush fee is charged per car and is non-refundable once outreach has started.
- Credit codes work once, can’t be exchanged for cash and are subject to our Refund Policy.
- We may change our prices at any time. Changes don’t affect orders already placed.
8. Refunds, credits and cancellations
Refunds, credits and cancellations are covered by our Refund Policy, which is part of these Terms. If you have a problem with a charge, please contact us before disputing it with your bank.
9. Communications
By placing an order, you agree that we may contact you by email, phone or text message at the details you give us about your order and your report. These messages are about your order, not marketing. After your report is delivered, we may send one email asking about your experience. Standard message and data rates may apply.
10. Acceptable use of the website
You agree not to misuse the Services. That includes placing fraudulent orders, using someone else’s payment method without permission, interfering with the website’s security or operation, scraping or copying the site with automated tools, or impersonating anyone.
11. Our content
The Truth Trade name and logo, our website, report format and all content we create are owned by Truth Trade and protected by law. Apart from the license to use your own report described above, you may not copy, modify or distribute our content without written permission.
12. Independence
Truth Trade is independent. We aren’t affiliated with any dealership, manufacturer, lender or vehicle history company, including Carfax®, and we don’t accept payment or referral fees from dealerships. All trademarks belong to their owners.
13. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that information provided by previous owners or third-party sources is accurate or complete, or that the website will be uninterrupted or error-free.
14. Limitation of liability
To the fullest extent permitted by law, Truth Trade’s total liability for any claim related to the Services is limited to the amount you paid for the report at issue. We aren’t liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, the price paid for a vehicle, repair costs, or decisions you make about buying a vehicle, even if we were told such damages were possible. Some states don’t allow certain limitations, so some of these may not apply to you.
15. Indemnification
You agree to defend and hold Truth Trade harmless from any claims, damages and costs, including reasonable attorneys’ fees, that arise from your misuse of a report or the Services or your violation of these Terms or the law.
16. Resolving disputes
If you have a concern, please email us first at info@truthtrade.co, or call (813) 550-5077. Most issues can be resolved quickly, and we’ll make a good-faith effort to do so within 30 days. If we can’t resolve it, either of us may bring a claim in small claims court where it qualifies.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute that isn’t brought in small claims court will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you and Truth Trade consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the date at the top of this page. The Terms in effect when you place an order apply to that order. Continuing to use the Services after a change means you accept the updated Terms.
18. General
- Entire agreement. These Terms, our Privacy Policy and our Refund Policy are the full agreement between you and Truth Trade about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a part of these Terms, that doesn’t mean we give up the right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganization of our business.
- Events outside our control. We aren’t responsible for delays caused by events beyond our reasonable control, such as service outages or natural disasters.
