These Terms of Use (“Terms”) govern your access to and use of the Truth Trade website, Services, and investigative vehicle reports. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. License Grant
Truth Trade grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial purposes in evaluating a vehicle for purchase or related decision-making. This license is provided based on your representations regarding authorized use and may be revoked at Truth Trade’s discretion.

2. Authorized Use
You may not resell, republish, redistribute, or create derivative works from our reports or Services without express written consent.
You may not impersonate Truth Trade or represent yourself as our agent to any third party.
You may not use automated tools (robots, spiders, scrapers) to access or extract data from our Services.
You may not introduce malware, viruses, or harmful code into our Services.
You may not frame or mirror any part of the Truth Trade website or content without prior consent.

3. Description of Services
Truth Trade provides investigative vehicle reports that may include:
Prior owner feedback and commentary.
Trade-in valuation or price history.
Accident, condition, or maintenance information, when available.
Reports are prepared using investigative methods, third-party data, and prior owner interviews. Because reports rely on external sources and cooperation, Truth Trade does not guarantee accuracy, truthfulness, or completeness of any information, nor can all undisclosed details be revealed.

4. No Guarantee of Results
Dealerships are not obligated to honor or adjust pricing based on a report.
Prior owners may refuse to respond or provide limited information.
Reports may not capture every accident, repair, or condition issue.
Reports are informational tools only and should not replace independent inspections, appraisals, or due diligence.

5. Variable Timeframes
Each investigation requires a different amount of time to complete. Some reports may be finalized after a single phone call, while others may require repeated attempts or extended follow-up. Turnaround times are estimates and are not guaranteed.

6. Payment and Billing
All payments are processed securely through Stripe. Truth Trade does not store credit card numbers.
By submitting payment, you authorize Truth Trade to charge your selected payment method for Services purchased.
Prices and packages are subject to change without notice.

7. Refund Policy
Reports are non-refundable once delivered.
If Truth Trade cannot complete an investigation (e.g., unable to locate prior owner), a partial refund or credit may be issued at our discretion.
Duplicate or erroneous transactions must be reported within 48 hours.

8. Intellectual Property
All content, methodology, branding, and reports are the exclusive property of Truth Trade 
You may not copy, reproduce, distribute, or modify our intellectual property without written authorization.
No ownership rights are transferred to you by using our Services.

9. Disclaimers
“As Is” Basis: All Services are provided “as is” and “as available.” Truth Trade disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy of content.
Third-Party Data: Reports rely on third-party sources and prior owner interviews. Truth Trade cannot guarantee the accuracy, completeness, or truthfulness of information provided by third parties.
No Condition Verification: Truth Trade does not confirm, deny, inspect, or certify the mechanical, structural, cosmetic, or safety condition of any vehicle.
No Liability: Truth Trade assumes no liability of any kind, for any reason, arising from the use of our Services, reliance on report contents, or outcomes of vehicle purchases, sales, or negotiations.

10. Indemnification
You agree to defend, indemnify, and hold harmless Truth Trade, its officers, employees, and agents from and against any claims, damages, liabilities, or expenses (including attorneys’ fees) arising out of:
Your misuse of our Services or reports.
Your violation of these Terms.
Your violation of the rights of any third party.

11. Third-Party Beneficiaries
To the extent our Services rely on information from third-party sources (including prior owners, public records, and data providers), those third parties are considered beneficiaries of these Terms with the right to enforce them directly against you.

12. Injunctive Relief
You acknowledge that any breach of these Terms may cause Truth Trade irreparable harm. In addition to monetary damages, Truth Trade is entitled to injunctive relief without posting bond.

13. Limitation of Liability
To the fullest extent permitted by law:
Truth Trade shall not be liable for any direct, indirect, incidental, consequential, punitive, or exemplary damages, including financial losses, reliance on report contents, or negotiation outcomes.
Truth Trade’s total liability for any claim shall not exceed the amount you paid for the Service that gave rise to the claim.

14. Survival of Terms
The provisions relating to disclaimers, use restrictions, intellectual property, indemnification, limitation of liability, governing law, and attorneys’ fees shall survive termination of your access to the Services.

15. Modification of Terms
Truth Trade may revise these Terms at any time. Updates are effective immediately upon posting. Continued use of our Services after such changes constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, without reference to conflict of law rules. Venue shall be exclusively in the courts of Hillsborough County, Florida.

17. Attorneys’ Fees
In any action arising out of these Terms, the prevailing party is entitled to recover reasonable attorneys’ fees and costs.

18. Class Action and Jury Waiver
To the fullest extent permitted by law:
All disputes must be brought in an individual capacity only, not as part of a class or representative action.
You waive any right to a jury trial in any legal proceeding related to these Terms.

19. Compliance with Law
Truth Trade operates in compliance with the Driver’s Privacy Protection Act (18 U.S.C. § 2721 et seq.) and Florida licensing requirements.

By purchasing a report, you agree not to misuse personal or vehicle information in violation of state or federal law.
